2. Acknowledgment of Risks
I understand that riding a bicycle or electric bicycle involves inherent risks, including falls, collisions, road hazards, uneven surfaces, weather conditions, equipment failure, and actions of other riders, motorists, or pedestrians. These risks may result in property damage, serious injury, permanent disability, or death.
I voluntarily choose to participate and accept the inherent risks associated with riding and using the rented equipment.
3. Rider Responsibilities
I agree to:
- Operate the bicycle responsibly and follow applicable traffic laws, posted signs, and local riding restrictions.
- Wear an appropriate helmet and use any required safety equipment.
- Inspect the bicycle before riding and immediately report any apparent damage, malfunction, or unsafe condition.
- Follow HarborRide's instructions and operate the bicycle within its intended capabilities.
- Never operate the bicycle while impaired by alcohol, drugs, fatigue, or any substance that affects my ability to ride safely.
- Never carry an unauthorized passenger or allow another person to use my rental without HarborRide's permission.
- Return the bicycle at the agreed time and in the condition received, except for ordinary wear and tear.
4. Equipment Damage and Loss
I accept responsibility for loss of or damage to the rented equipment caused by my negligence, misuse, unauthorized use, or violation of the rental agreement, subject to applicable law.
I understand that I may be charged for reasonable repair or replacement costs for damage or loss for which I am responsible. I will not be automatically charged for ordinary wear and tear, pre-existing damage, or a mechanical failure not caused by my actions.
I agree to report accidents, theft, damage, and mechanical problems to HarborRide as soon as reasonably possible.
5. Release of Liability
To the fullest extent permitted by Massachusetts law, I release HarborRide, its owners, employees, and authorized representatives from claims for injury, loss, or damage arising from the inherent risks of my voluntary participation in bicycle or electric bicycle riding.
This release is not intended to waive claims that cannot legally be waived, including liability for gross negligence, reckless or intentional misconduct, or other liability that applicable law does not permit me to release.
6. Emergency Assistance
If an accident or medical emergency occurs, I authorize reasonable efforts to contact emergency services and my designated emergency contact when appropriate. I understand that I am responsible for my medical expenses except where otherwise required by law or covered by applicable insurance.
7. Confirmation and Electronic Signature
By signing below, I confirm that:
- I have read and understood this waiver.
- I have had the opportunity to ask questions before signing.
- I am voluntarily participating and agree to follow HarborRide's rental rules and safety instructions.
- The information I have provided is accurate.
